1. Acceptance of Terms

Welcome to Novira ("Platform", "we", "us", or "our"). By accessing or using our website, applications, or other services (collectively, the "Services"), you agree to be legally bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, you must not access or use the Platform. These Terms apply to all visitors, authors, artists, readers, and any other persons who access the Services ("Users").

These Terms form a binding legal agreement between you and Novira. By clicking "I Agree," creating an account, or using the Services in any way, you confirm that you have read, understood, and consent to be bound by these Terms and our Privacy Policy.

2. Accounts & Age Restrictions

2.1 Minimum Age

You must be at least 13 years old to use the Services. If you are between 13 and 18, you represent that you have explicit permission from a parent or legal guardian to use Novira and that your guardian has reviewed and agrees to these Terms on your behalf.

2.2 Mature Content (18+)

Certain content on Novira is labeled "Mature" and is restricted exclusively to users aged 18 or older. By accessing such content, you affirm that you are at least 18 years of age and that viewing mature content is legal in your jurisdiction. Misrepresenting your age to access restricted content is a violation of these Terms and may result in immediate account termination.

2.3 Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account information up to date.
• Maintain the security of your account (your email is your universal login via passwordless OTP).
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

2.4 One Account Per Person

Each individual may maintain only one active Novira account. Creating duplicate or multiple accounts to circumvent bans or platform limits is strictly prohibited.

2.5 Publisher and Payout Verification

A standard Creator account requires only a verified email address. If creator monetization or payouts are introduced in a future update, additional identity or payout verification may be required before funds can be released. We will explain those requirements before collecting that information.

3. Content & UGC Licensing

3.1 User-Generated Content (UGC)

Novira is a platform for user-generated content. You are solely responsible for all content you submit, post, or make available on the Platform ("Content"), including its legality, accuracy, and appropriateness.

3.2 You Own Your Work

Novira does not claim ownership of your creative work. You retain all intellectual property rights, including copyright and any applicable moral rights, in any original Content you submit to the Platform.

These Terms do not assign, sell, transfer, or exclusively license your creative work to Novira. You remain free to publish, license, sell, remove, adapt, or distribute your work elsewhere, subject to any separate agreement you choose to enter into.

3.3 License Granted to Novira

When you publish Content on Novira, you grant Novira a limited, non-exclusive, worldwide, royalty-free, non-transferable, and non-sublicensable license to host, store, cache, reproduce, display, transmit, and technically format that Content only as necessary to provide, maintain, secure, moderate, and improve the Services.

This limited license allows Novira to do ordinary platform operations such as showing your story or episode to readers, generating thumbnails and previews, making backups, enabling reader features, indexing your work in search or Explore pages, displaying your public creator profile, and delivering Content through web, mobile, offline-reading, accessibility, caching, and content-delivery systems.

Service providers who help us run the Platform, such as hosting, storage, security, analytics, moderation, translation, or content-delivery providers, may process Content only on Novira's behalf. They do not receive any independent right to publish, sell, license, exploit, or reuse your creative work.

Novira will not sell your Content, license your Content to another publisher, create derivative commercial editions of your Content, or use your Content to train third-party generative AI models without your express consent or a separate written agreement.

3.4 Promotional Use

Novira may use limited parts of public Content to promote that specific work, its creator, or the Platform. This includes your title, creator name, cover image, thumbnail, short excerpt, genre, public description, public profile information, and links to your work.

Promotional use is limited to Novira-owned or Novira-controlled surfaces, including the homepage, Explore pages, newsletters, app previews, press kits, and official social media posts. We will not reproduce a full chapter, full episode, full comic page sequence, or a substantial portion of your work in external marketing without your express consent.

We may resize, crop, or format covers, thumbnails, and short excerpts for layout or accessibility, but we will not intentionally alter the meaning, authorship, title, or integrity of your work for promotional use. If you do not want a specific work used in external promotional material, contact [email protected]; we will stop new external promotional use within a reasonable time.

3.5 Deletion and End of License

The license in Sections 3.3 and 3.4 ends when you delete the relevant Content from the Platform, except that copies may remain for a limited time in routine backups, cache, logs, audit records, legal compliance records, or already-delivered technical systems. Public display of deleted Content will stop as soon as reasonably practicable, and backup or cache copies are normally overwritten within 90 days.

3.6 AI-Generated Content

If any portion of your published Content was created with the assistance of an AI tool (including but not limited to image generators, text AI, or translation tools), you must disclose this clearly in your story's description or relevant chapter note. Failing to disclose AI-assisted content when asked by a moderator is a violation of these Terms.

3.7 Content Accuracy & Disclaimers

All fiction published on Novira is presented for entertainment purposes only. Any resemblance to real persons (living or dead), actual events, or real organizations is coincidental unless clearly labeled as a non-fiction or commentary work.

4. Copyright & DMCA Policy

Novira respects intellectual property rights and expects the same from our community. We comply with the Digital Millennium Copyright Act (DMCA) and respond expeditiously to valid notices of alleged copyright infringement.

4.1 How to Submit a DMCA Notice

If you believe content on Novira infringes your copyright, please send a written notice to our Designated Copyright Agent at:

Your notice must include:

• Your physical or electronic signature (or the signature of the person authorized to act on behalf of the copyright owner).
• A description of the copyrighted work you claim has been infringed.
• The exact URL(s) on Novira where the infringing material is located.
• Your contact information: name, address, telephone number, and email address.
• A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

4.2 Counter-Notice

If you believe your content was removed due to a mistake or misidentification, you may send a counter-notice to [email protected]. We will restore the content within 10–14 business days if the claimant does not file a court action during that period.

4.3 Repeat Infringer Policy

It is our policy, in appropriate circumstances, to permanently terminate the accounts of users who are proven repeat copyright infringers.

5. Prohibited Conduct

To protect the integrity and safety of our community, the following is a summary of what is and is not permitted on Novira:

Novira reserves the right to determine, at its sole discretion, whether any Content or behavior violates this section. Violation may result in content removal, account suspension, or permanent ban.

6. Moderation & Enforcement

We believe in fair and transparent enforcement. Our moderation team reviews reported content and accounts. The standard enforcement ladder is as follows:

1. Warning: A formal notice is sent to your registered email explaining the violation. No content action is taken on a first-time minor violation.
2. Content Removal: The offending content is removed from the Platform. A notice is sent to you.
3. Temporary Suspension: Your account is suspended for a defined period (3–30 days) depending on severity. You may not access the Platform during this period.
4. Permanent Ban: Your account is permanently terminated. This action is taken for severe, repeated, or egregious violations (e.g., CSAM, doxing, proven repeat copyright infringement).

6.1 Appeals

If you believe a moderation action against your account was made in error, you may appeal by emailing [email protected] within 14 days of the action, with the subject line "Moderation Appeal." Include your username, the content in question, and a detailed explanation. We aim to respond within 5 business days where possible, though complex cases may take longer.

6.2 Proactive Monitoring

We reserve the right — but are not obligated — to proactively monitor Content for compliance with these Terms and applicable laws. We employ automated tools (including NSFW detection) to assist with this effort.

7. Disclaimers & Limitation of Liability

7.1 "As Is" Service

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, Novira and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or any Content thereon.

7.3 User Content Disclaimer

Novira does not endorse or verify the accuracy of user-generated content. Opinions expressed in stories, comments, or profiles are those of the respective authors and do not represent the views of Novira.

8. Governing Law & Dispute Resolution

8.1 Governing Law

These Terms and any contract dispute arising from your use of the Platform are governed by the laws of India, including applicable intermediary, data-protection, consumer-protection, and information-technology laws, except where mandatory laws in your country or state of residence provide rights that cannot be waived by contract.

Copyright ownership, copyright infringement, moral rights, privacy rights, consumer rights, and other non-waivable statutory rights may also be governed by the laws of the jurisdiction that legally applies to that specific claim. Nothing in these Terms is intended to take away rights that applicable law does not allow you to waive.

8.2 Jurisdiction

Before filing a court claim about these Terms, you and Novira agree to first try to resolve the dispute in good faith by emailing [email protected] and allowing 30 days for a written response, unless urgent injunctive relief is needed or applicable law requires otherwise.

For disputes that must be brought in court and are not subject to a mandatory local consumer, copyright, privacy, or other statutory forum, the courts having jurisdiction over Novira's registered place of business in India will have jurisdiction. This clause does not prevent users or rightsholders from submitting copyright notices, counter-notices, payment disputes, consumer complaints, or other claims in any forum where applicable law gives them a non-waivable right to do so.

8.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

9. Advertising & Sponsored Content

Novira may display advertising on the Platform to support its operations and future creator-support programs. All advertising on Novira is governed by the following principles:

a. Clear labelling. Every paid or sponsored placement is explicitly marked "Sponsored." We do not disguise advertising as editorial content or organic recommendations.

b. No in-chapter interruption. Advertisements will never appear inside the body of a story chapter, between paragraphs, or in any position that interrupts the reading experience. Placements are limited to page headers, footers, and between-chapter positions.

c. Context-only targeting. Novira does not build behavioural profiles of users for advertising purposes. Ad targeting is limited to contextual signals — the genre, format, and language of content being read — and never includes personal data, browsing history, or cross-site tracking.

d. No data sold to advertisers. We do not share, sell, or license individual user data to advertisers. Advertisers receive only aggregate, anonymised performance metrics (impressions and clicks).

e. Prohibited ad categories. Novira will not accept advertising for gambling products, cryptocurrency speculation, payday lending, adult content, or any product primarily targeting users under 18.

f. Creator revenue share (planned). Novira intends to build a creator-support fund in a future update. This feature will be announced only when the payout system is ready. Until then, ad revenue supports platform operations.

g. Advertiser review. All advertisers are reviewed manually before any campaign goes live. Novira reserves the right to reject or remove any advertiser or ad creative that conflicts with these principles or the spirit of the Platform.

10. Expansion Credits & Translation Beta

Novira is testing an automated language expansion workflow for selected stories and chapters. This workflow uses local translation models, third-party translation providers, and AI assistant tools to create machine-assisted translation drafts.

a. Expansion Credits are capacity funding. If Expansion Credits are offered during beta, they help fund provider usage, higher API limits, and cloud server infrastructure. They are not a guarantee of instant translation, perfect quality, ranking preference, or automatic publication.

b. Draft generation and editing. Translation drafts are generated for the author to review, edit, and format before publishing. Authors are responsible for editing the drafts to meet platform quality or safety standards.

c. Failed attempts and reuse. If a provider fails or returns unusable output, Novira may restore or refund the related credits for another expansion request at our discretion.

d. Release windows. Novira may delay automated draft releases to protect original creators, avoid leaks, and maintain fair first-release visibility for the source language.

e. Experimental status. Expansion tools are beta systems. Available languages, providers, limits, pricing, and draft generation times may change as we evaluate quality, cost, safety, and provider reliability.

11. Translation Tool & Uploaded Content

Novira offers a self-service Translation Tool that lets you upload comic, manga, manhwa, or webtoon pages (or similar images) and receive a machine-assisted translation that you can edit and download. This Section governs your use of that tool and applies in addition to the rest of these Terms. It is separate from Novira's own original stories (Section 3) and from the internal Expansion workflow (Section 10).

11.1 Your Responsibility for Uploaded Content

You may only upload content that you own or that you are otherwise legally permitted to translate. By uploading any file to the Translation Tool, you represent and warrant that you hold the necessary rights, licences, consents, or permissions to use, copy, and translate that content, and that doing so does not infringe the copyright, trademark, privacy, or other rights of any third party. You are solely responsible for the content you upload and for how you use the translated output.

11.2 Novira Is a Tool, Not a Distributor

The Translation Tool provides automated processing only. Novira does not select, curate, publish, host as a public library, or distribute the third-party content you upload through this tool. Translated output is generated for you and returned to you for your own use. Novira does not make uploaded third-party content or its translations available to other users, and such content does not form part of Novira's public catalogue.

11.3 Temporary Processing & Limited Retention

Files you upload to the Translation Tool, and the outputs generated from them, are processed on a temporary basis. They are stored only for as long as needed to complete processing and to let you edit and download your result within your session. We do not add this content to any public or shared library. We aim to remove temporary uploads and outputs from active processing storage promptly after the session or download window ends, but residual copies may persist for a limited period in logs, caches, failed-job records, or secured backups before being overwritten.

11.4 Machine Translation Is Provided "As Is"

Translations produced by the tool are machine-assisted and may contain errors, omissions, mistranslations, or formatting issues. They are provided for your convenience without any warranty of accuracy, completeness, or fitness for a particular purpose. You are responsible for reviewing and correcting output before relying on it or sharing it.

11.5 Prohibited Uses of the Translation Tool

In addition to the conduct rules in Section 5, you must not use the Translation Tool to:

• Upload, process, or translate content you do not own or have permission to use;
• Circumvent, bypass, or interfere with any digital rights management (DRM), paywall, access control, or other technical protection measure on any platform or work;
• Scrape, harvest, or automatically extract content from third-party services without authorisation;
• Reproduce, publish, distribute, or commercially exploit translated output in any way that infringes the rights of the original rightsholder.

11.6 Indemnification

You agree to defend, indemnify, and hold harmless Novira and its affiliates, officers, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to the content you upload to the Translation Tool, your use of the translated output, or your breach of this Section.

11.7 Copyright Complaints

If you are a rightsholder and believe the Translation Tool has been used to infringe your work, please contact our Designated Copyright Agent at [email protected]. Our Copyright & DMCA process (Section 4), including our repeat-infringer policy, applies to use of the Translation Tool.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and, where practicable, by sending an email notification to your registered address.

Your continued use of the Platform after any changes take effect will constitute your acceptance of the revised Terms. We encourage you to review these Terms periodically. The "Effective Date" at the top of this page indicates when the Terms were last updated.
